Terms of Service

1. Agreement to terms
By accessing or using the Fast Tracking Laos platform (“Service”) you agree to be bound by these Terms of Service (“Terms”). If you are accepting these Terms on behalf of a company or organisation, you represent that you have authority to bind that entity.
2. Service description
The Service enables merchants and logistics providers to send automated WhatsApp notifications to their customers about order and delivery status in Laos. Fast Tracking Laos acts as a communications processor and does not assume responsibility for the underlying shipment or logistics operations.
3. Account responsibilities
- You must provide accurate business contact information and maintain confidentiality of your login credentials.
- You will ensure customer phone numbers and message content comply with WhatsApp Business policies and applicable laws.
- You are responsible for responding to customer replies or escalations generated through the Service.
4. Acceptable use
- Do not use the Service to send spam, fraudulent content, or unlawful communications.
- Do not attempt to gain unauthorised access to the Service or disrupt its availability.
- Do not transmit content that infringes intellectual property, privacy, or data protection rights.
5. Data processing
Fast Tracking Laos processes personal data as described in our Privacy Policy. You, as the data controller, are responsible for obtaining necessary consents and providing required notices to your customers.
6. Fees and payment
Subscription pricing, message credits, and payment terms are set out in the commercial agreement signed with each client. Fees are payable in Lao Kip or USD within 14 days of invoice unless otherwise agreed in writing.
7. Service availability
We strive to offer 99% uptime excluding scheduled maintenance. We may suspend access without liability when necessary to protect the Service, comply with regulations, or address non-payment.
8. Intellectual property
All software, branding, and documentation associated with Fast Tracking Laos remain our exclusive property. Clients retain ownership of their customer data and content transmitted through the Service.
9. Disclaimers
The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted delivery of WhatsApp messages, which may depend on third-party networks and user device settings.
10. Limitation of liability
To the maximum extent permitted by law, Fast Tracking Laos is not liable for indirect, incidental, or consequential damages. Our total liability in any 12-month period is limited to the fees paid by you for the Service during that period.
11. Termination
Either party may terminate the Service with 30 days’ written notice. We may terminate immediately if you violate these Terms, fail to pay fees, or compromise Service security. Upon termination you must stop using the Service and delete any access tokens provided.
12. Governing law
These Terms are governed by the laws of the Lao People’s Democratic Republic. Any dispute will be resolved by the competent courts of Vientiane, Laos.
13. Changes to Terms
We may modify these Terms from time to time. Continued use of the Service after notice of changes constitutes acceptance of the updated Terms.
